When Do You Need a DOT SAP Evaluation?

DOT rules require a SAP evaluation after a DOT drug or alcohol regulation violation before an employee can return to DOT safety-sensitive duties. Common triggering events include a verified positive DOT drug test, an alcohol test at 0.04 or greater, a refusal to test, or another DOT drug/alcohol rule violation.

Regulatory process details are based on DOT 49 CFR Part 40, Subpart O. For federal guidance, see the DOT Substance Abuse Professionals page.

The DOT Return-to-Duty SAP Process

The SAP process is structured by DOT rules. We explain each step clearly so you know what is required, what documentation matters, and when the return-to-duty test can happen.

1

Initial SAP Evaluation

A face-to-face clinical assessment, in person or by qualifying real-time audio/video technology, to determine what assistance is needed.

2

Education or Treatment Recommendation

DOT rules require a recommendation for education and/or treatment after a DOT drug or alcohol regulation violation.

3

Follow-Up Evaluation

After you complete the recommendation, the SAP re-evaluates compliance and reports whether you demonstrated successful completion.

4

Return-to-Duty Test and Follow-Up Plan

If your employer chooses to return you to safety-sensitive work, a negative return-to-duty test is required before resuming duties.

What to expect

A Direct, Organized SAP Evaluation

A SAP is not an advocate for the employer or the employee. DOT defines the SAP role as protecting public safety through professional evaluation, recommendations, follow-up testing, and aftercare.

A nonjudgmental clinical interview focused on DOT compliance and public safety.
Clear explanation of your next steps, expected documentation, and timeline.
Written reports sent directly to the designated employer representative when required.
A follow-up testing plan after successful compliance with recommendations.

Frequently Asked Questions

When is a DOT SAP evaluation required?

A SAP evaluation is required after a DOT drug or alcohol regulation violation before an employee can return to DOT safety-sensitive duties. DOT lists verified positive drug tests, alcohol test results of 0.04 or greater, refusals to test, and other DOT drug/alcohol rule violations as qualifying violations.

Can I choose any SAP?

You can choose your SAP provider, but the provider must meet DOT SAP qualification requirements. I provide DOT-qualified SAP evaluations for New Jersey clients.

Can I get a second opinion?

No. Once a SAP performs the initial evaluation, DOT rules do not allow another party to change that SAP's evaluation or recommendations. Choose your SAP carefully before starting.

How much do SAP evaluations cost?

Initial SAP evaluation is $400 and follow-up evaluation is $200. SAP evaluations are employment-compliance services and are not covered by insurance. Payment is due at time of service. Credit/debit cards accepted. Bundled rate is $500 if you pay for both evaluations upfront.

Can I do the evaluation remotely?

Remote SAP evaluations may be conducted when they meet DOT requirements for real-time audio and visual interaction, sufficient technology quality, and confidentiality. I offer virtual and in-person options for New Jersey clients when appropriate.

Will my employer know the clinical details?

The required SAP reports go to the designated employer representative. The reports address required compliance items such as recommendations, compliance status, and follow-up testing plan. Detailed therapy-style clinical notes are not shared as general workplace updates.

What if I don't complete the recommended treatment?

DOT rules require successful compliance with the SAP's education and/or treatment recommendations before a return-to-duty test can occur.

How many follow-up tests will I need?

DOT requires at least six unannounced follow-up tests in the first 12 months after return to safety-sensitive duties. The SAP may require additional testing during that first year and may require follow-up testing for up to 48 additional months.

Does the SAP decide if I get my job back?

No. The SAP determines compliance with recommendations and provides the required reports. DOT states that the employer decides whether to return an employee to a safety-sensitive position.
